Acceptable Usage Policy

INTRODUCTION
This Acceptable Usage Policy (“AUP”) governs the use of the NOUMENA Protocol Language (“NPL”), NPL Runtime Environment, and related development and DevOps tools (collectively referred to as "NOUMENA Software") provided by NOUMENA. By accessing or using the NOUMENA Software, you agree to abide by this AUP.
If you violate this AUP, NOUMENA may suspend your use of NOUMENA Software. This AUP may be updated by NOUMENA from time to time upon reasonable notice, which may be provided via your NOUMENA account, e-mail, or by posting an updated version of this AUP at https://www.noumenadigital.com/AUP.
AUTHORIZED USAGE
Users are authorized to use NOUMENA Software solely for the purposes as outlined in the License Agreements and Terms of Use, found here: https://noumenadigital.com/product-licenses/.
NO INAPPROPRIATE CONTENT OR USERS
Do not use NOUMENA Software to transmit or store any content or communications (be it commercial or other) that are illegal, harmful, unwelcome, inappropriate, or objectionable. This includes content or communications which NOUMENA Software finds to be:
- false or misleading;
- incendiary or promoting hatred or violence towards individuals or groups; or
- potentially threatening to public safety.
This restriction extends to the utilization of NOUMENA Software by any hate groups. Both you and your end users are forbidden from employing NOUMENA Software to endorse, or facilitate the transmission of or access to, any forbidden content or communications as described in this clause.
PROHIBITED USAGE
Do not use NOUMENA Software to engage in or encourage any activity that is illegal, deceptive, harmful, a violation of others’ rights, or harmful to NOUMENA’s business operations or reputation, including:
- Unlawful Material: Sending or storing any unlawful, obscene, threatening, libelous, or other malicious materials, including but not limited to those harmful to children or in violation of third-party privacy rights.
- Spamming: Sending spam or any unsolicited messages in violation of applicable laws.
- Malware: Sending or storing malware, including but not limited to, viruses, worms, Trojan horses, or other harmful code, files, scripts, agents, or programs.
- Commercial Exploitation: Licensing, sublicensing, selling, reselling, transferring, assigning, distributing or otherwise exploiting the NOUMENA Software for commercial purposes without the explicit permission of NOUMENA.
- Modification and Derivative Works: Altering the NOUMENA Software or creating derivative works based on it without written consent from NOUMENA.
- Removal or Modification of Proprietary Notices: Removing or altering any proprietary rights notices included in the NOUMENA Software.
NO SERVICE INTEGRITY VIOLATIONS
Do not engage in or encourage any activity that violates the integrity of NOUMENA Software, including, but not limited to:
- Bypassing Service Limitations. Attempting to bypass, exploit, defeat, or disable limitations or restrictions placed on the Services.
- Security Vulnerabilities. Finding security vulnerabilities to exploit the Services or attempting to bypass any security mechanism or filtering capabilities.
- Disabling the Services. Any denial of service (DoS) attack on the Services or any other conduct that attempts to disrupt, disable, or overload the Services.
- Harmful Code or Bots. Transmitting code, files, scripts, agents, or programs intended to do harm, including viruses or malware, or using automated means, such as bots, to gain access to or use the Services.
- Unauthorized Access: Attempting to gain unauthorized access to the NOUMENA Software or its related systems or networks.
REPORTING SUSPECTED VIOLATIONS
We encourage you to report suspected violations of this AUP to us via email at info@noumenadigital.com. We have a policy to investigate all of these reports and respond as we consider appropriate.
ENSURING COMPLIANCE
NOUMENA reserves the right to inspect and audit users' records to ensure compliance with this AUP, License Agreement, Terms of Use, and other applicable terms and conditions, both during the term of any agreement and for a period of three years following its termination.
You are required to cooperate with such audits, provide reasonable assistance, and furnish access to pertinent information. If necessary, for export control checks, you are obligated to promptly provide NOUMENA with detailed information regarding the end customer, destination, and intended use of the NOUMENA Software, as well as any export control restrictions, upon request by NOUMENA.
NOTICE
NOUMENA may give notice of non-compliance and enforcement by means of a general notice on the Software, electronic mail to your e-mail address on record in NOUMENA’s account information, or by written communication sent by first class mail or pre-paid post to Your address on record in NOUMENA’s account information. Such notice shall be deemed to have been given upon the expiration of 48 hours after mailing or posting (if sent by first class mail or pre-paid post) or 12 hours after sending (if sent by email).
